Location Data Collection and Usage

Our app collects and uses location data (such as GPS coordinates) to provide delivery services. This includes displaying maps and real-time location information for delivery personnel to navigate between pickup and delivery locations. The location data is used solely for the purpose of facilitating the delivery process and is not shared with third parties, except as necessary to provide these services (e.g., through third-party mapping services). You will be prompted to grant location access when using the app, and you can manage or revoke location permissions at any time through your device's settings. We take the privacy and security of your data seriously and implement measures to protect it.


This document is an electronic record drafted in terms and according to the Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. By clicking on the “I ACCEPT” button, You are consenting to be bound by these T&C for using the UDIBABA Application for the purpose of receiving orders and delivering fresh and quality fruits and vegetables to the users. PLEASE ENSURE THAT YOU READ AND UNDERSTAND ALL THESE USER APPLICATION T&C BEFORE YOU USE THE SERVICE OF THE UDIBABA APPLICATION, AS YOU SHALL BE BOUND BY ALL THE T&C CONTAINED HEREIN upon clicking on the “I ACCEPT” button.

Definitions

Unless otherwise construed by any other law, the following words shall have the meaning assigned to them hereunder :-

“Zakumi” or “We” or “Us” or “Our” or “Company” shall mean Zakumi Trading Company, a company registered and having its registered office at Zakumi Trading Company, Plot No.11 RAMAI NAGAR, KAPIL NAGAR CHAWK, NEAR DURGA MATA MANDIR, BESIDE PRAJAPATI KIRANA, Nagpur, which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include all our successors, affiliates and permitted assigns;

“UDIBABA Delivery Application” shall mean and include the application created by the Zakumi Trading Company for the purpose of delivery of vegetables to the users of the said application. It shall also include for all purposes the mobile interface provided to the Delivery/Transport Co. wherein all the back-end technology is incorporated to enable the Delivery/Transport Co. to provide Delivery Services as well as enable Zakumi to track the orders and other relevant information.

“UDIBABA User Application” shall mean and include the application created by the Zakumi Trading Company for the purpose of delivery of vegetables to the users of the said application.

“Users” with respect to the use of UDIBABA application shall include but not limited to Retail end customer, Business Enterprises, supermarkets, Local Vegetable vendors, restaurants or catering companies.

“Acceptance” means your affirmative action of clicking on the box against the words “I Accept” provided at the end of this document, by which action, you unequivocally understand and accept the terms and conditions and any modifications made in the future thereof;

“Applicable Law” shall mean and include any law, statute, ordinance, rule, regulation, guideline, policy or other pronouncement having the effect of law in India, as in effect or which may come in effect on a future date;

“Delivery/Transport Co.” shall mean an individual or Company who has executed Agreement for the provision of Delivery Services;

“Delivery Services” shall mean either or both of the following as the context may require:
The services provided by the Delivery/Transport Company to Zakumi Trading Co. of making himself available on the Udibaba Application for the purpose of receiving orders placed by the Users;
The delivery services provided by the Delivery/Transport Co. to the Users whereby the Delivery/Transport Co. collects the Vegetables ordered by the Users and delivers the same to the Users.

“Intellectual Property Rights” shall mean and include the copyright (whether registered or not), patents including rights of filing patents, trademarks, trade names, trade dresses, house marks, collective marks, associate marks and the right to register them, designs (both industrial and layout), geographical indicators, moral rights, broadcasting rights, displaying rights, distribution rights, selling rights, reproducing rights, domain names, internet address, graphics, artwork, links, information, logos, software, configuration, marketing and distribution material and any other intellectual property right in the website of Zakumi, and Udibaba Application, which are used and/or owned or claimed by Zakumi;

“Terms and Conditions” refers to the Terms and Conditions, which are available on the Udibaba Application as well as the Zakumi Company’s official Website as may be amended from time to time;

PART I

Zakumi Manager Policy

Zakumi Trading Company is registered company having its registration Certificate No. UDYAM-MH-20-0061166 with its registered office at Zakumi Trading Company, Plot No, 11 RAMAI NAGAR, KAPIL NAGAR CHAWK, NEAR DURGA MATA MANDIR, BESIDE PRAJAPATI KIRANA, Nagpur, Maharashtra India. The said company has launched an application by the name of UDIBABA with the purpose of selling fresh and quality vegetables and fruits and other Grocery items to its Users. The application is primarily a B2C (Business to Customer) with its target customers/users being other business classes including but not limited to Retail Domestic Customer. Udibaba is a product of Zakumi Trading company, one of future many application which the company may launch from time to time.

Zakumi trading company has launched the Udibaba delivery Application solely for the Company and its Delivery/Transport Company who has undertaken to deliver the products of the company to its users. The Delivery/transport terms and conditions have been drafted and the users are advised to read the same before using the application. The company has also launched the Udibaba User Application for its end customers/users such as domestic retail cutomer.

Zakumi trading Company is well equipped with various team for the enhancement of the Udibaba Application and other ventures of the like in future as well as to look after the complete satisfaction of the Users. The company is equipped with the following team :-

  • Sales Team: Zakumi Trading company has a well efficient and qualified group of sales Team which looks after the day to day sales of the company.
  • Purchase Team: The company also appointed a separate set of team to look after the day to day purchase through Udibaba application.
  • Back End Team: Zakumi has a group of qualified individuals to look into the day to day running of the application and other allied activities.
  • Support Staff: Zakumi Trading Company has a customer friendly basis and has a separate team to look into the daily queries and doubts of its users.

Zakumi Trading Company and/or its affiliates ("Zakumi," "the Company," "we," "us," and "our") respect your privacy and are committed to protecting it through compliance with its privacy policies. Zakumi Trading Company is the licensed owner of the application Udibaba. Zakumi Trading Company respects your privacy.

When you click on an offer wall, you will be brought to an external website belonging to other persons and will leave our application(s). A unique identifier, such as your user ID, will be shared with the offer wall provider in order to prevent fraud and properly credit your account with the relevant reward.

9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.


Information You Provide to Us

The information we collect on or through our Services may include:

  • Your account information: Your full name, email address, postal code, password, and other information you may provide with your account, such as your gender, mobile phone number, and website. Your profile picture that will be publicly displayed as part of your account profile. You may optionally provide us with this information through third-party sign-in services such as Facebook and Google Plus. In such cases, we fetch and store whatever information is made available to us by you through these sign-in services.

You have the option to request your friends to join the Services by providing their contact information. If you request a friend to join and connect with you on the Services, we will only use your friend's contact information to process your request.

Services of the Application “Udibaba” would be available to only select geographies in India. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Application of Udibaba (E-commerce B To C Online Application). If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use this application only under the supervision of a parent or a legal guardian who agrees to be bound by these Terms of Use. If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You can close your account by visiting your profile settings page on our website.
